Sexual Assault & Sexual Harassment Defined

Sexual Assault is intentional sexual contact characterized by use of force, threats, intimidation, or abuse of authority, or when the victim does not or cannot consent. The term includes a broad category of sexual offenses consisting of the following specific UCMJ offenses: rape, sexual assault, aggravated sexual contact, abusive sexual contact, nonconsensual sodomy (oral or anal sex), or indecent assault (unwanted, inappropriate sexual contact or fondling). Sexual Assault is criminal conduct that falls well short of the standards America expects of its people in uniform and is a violation of our Air Force Core Values.

Sexual Harassment is any conduct that involves unwanted sexual advances, requests for sexual favors, and deliberate or repeated offensive comments or gestures of a sexual nature when:

• Submission to such conduct is made either explicitly or implicitly a term or condition of a
person's job, pay, or career.
• Submission to or rejection of such conduct by a person is used as a basis for career or
employment decisions affecting that person.
• Such conduct has the purpose or effect of unreasonably interfering with an individual's
work performance or creates an intimidating, hostile, or offensive environment; and is so
severe or pervasive that a reasonable person would perceive, and the victim does
perceive, the environment as hostile or offensive.

This definition emphasizes that conduct, to be actionable as harassment, does not need
to result in concrete psychological harm to the victim, but rather only be so severe or pervasive that a reasonable person would perceive the environment as hostile or offensive. Any person in a supervisory or command position who uses or condones sexual behavior to control, influence, or affect the career, pay, or job of a Service member or DoD civilian employee is engaging in sexual harassment. A Service member or DoD civilian employee who makes deliberate or repeated unwelcome verbal comments, non-verbal, or physical contact of a sexual nature is engaging in sexual harassment.

Consent is words or overt acts indicating a freely given agreement to the sexual conduct at issue by a competent person. Sexual assault occurs when consent is not given for sexual contact. Lack of consent can be assumed regardless of whether a victim resists physically. Consent is also not given when a person uses force, threat of force, coercion or when the victim is asleep, incapacitated (due to drugs, alcohol, or other foreign substances) or unconscious. A current or previous dating relationship or the manner of dress of the person involved with the accused in the sexual conduct at issue shall not constitute consent.

Reporting Options

Reporting Options:
The Air Force is committed to ensuring sexual assault survivors are protected, treated with dignity and respect, and provided support, advocacy and care. To achieve these objectives, the Air Force offers two (2) reporting options: Restricted and Unrestricted.

Restricted Reporting allows adult survivors of sexual assault to confidentially disclose the crime to a Sexual Assault Response Coordinator (SARC), SAPR Victim Advocate (VA), or health care personnel without triggering an investigation. Information provided to the chain of command does not reveal personally identifying information about the survivor or alleged offender. Restricted Reporting allows the survivor to receive legal advice, medical treatment, and advocacy services. It is intended to remove barriers to medical care and support while allowing the survivor increased time and control over the release and management of personal information.

Restricted Reporting is available to:
- Active Duty members and their dependents, 18 years of age & older (who are eligible for treatment in the military health system)
- Air Force Reserve and Air National Guard members in Title 10 status
- Air Force civilian employees

Unrestricted Reporting allows adult survivors of sexual assault to report crimes without requesting confidentiality of their allegations. DoD law enforcement initiates an investigation, and the chain of command is notified. Unrestricted Reporting allows survivors to receive medical treatment, advocacy services, legal support, and eligibility for Expedited Transfers or Military Protective Orders. In addition, Unrestricted Reporting allows survivors of sexual assault to report retaliation in the SAPR program.

Unrestricted Reporting is available to:
- Active Duty members and their dependents, 18 years of age & older (who are eligible for treatment in the military health system)
- Air Force Reserve and Air National Guard members in Title 10 status
- Air Force civilian employees and their dependents, 18 years of age & older (OCONUS)
- DoD contractor personnel assigned to contingency operations OCONUS

Independent Investigations occur when an assault is brought to attention by someone other than the survivor and the assault is reported to a Military Criminal Investigation Organization (MCIO) and an official investigation is initiated.

Victims' Counsel (VCs) are active duty judge advocates (JAG) whose sole role is to represent victims in a confidential,  attorney-client relationship, throughout the investigation and prosecution process.  SVCs will serve as a victim's personal attorney at the Air Force's expense.
